How this works in practice

The new sanctions regime, which foresees, in particular, a framework for deciding travel bans and freezing of funds against people listed in a sanctions list, was published in the EU Official Journal on 15 January 2024.

It is a two-folder regime, composed of an EU Council Decision on the one hand and an EU Regulation on the other hand. While the Decision has a more political character and is legally binding on the EU Member States, the Regulation has an immediate binding effect on all economic actors and people.

As the Regulation does not need implementing measures on the level of the EU Member States, it enters immediately into force on the date indicated in the final provisions of the Regulation.

For the Guatemala Regulation of 12 January 2024, Article 20 indicates that it shall enter into force on the day following its publication in the Official Journal of the European Union. In the case at stake, this would be 16 January 2024.
