New EU Sanctions Against Guatemala: Knowledge Base

Knowledge Base

RespectUs, a leader in global export control compliance solutions, has announced immediate updates to its platform in response to the latest European Union sanctions against Guatemala. RespectUs is committed to ensuring its users can navigate these changes efficiently and comply with all regulations.

How this works in practice

The new sanctions regime, which foresees, in particular, a framework for deciding travel bans and freezing of funds against people listed in a sanctions list, was published in the EU Official Journal on 15 January 2024.

It is a two-folder regime, composed of an EU Council Decision on the one hand and an EU Regulation on the other hand. While the Decision has a more political character and is legally binding on the EU Member States, the Regulation has an immediate binding effect on all economic actors and people.

As the Regulation does not need implementing measures on the level of the EU Member States, it enters immediately into force on the date indicated in the final provisions of the Regulation.

For the Guatemala Regulation of 12 January 2024, Article 20 indicates that it shall enter into force on the day following its publication in the Official Journal of the European Union. In the case at stake, this would be 16 January 2024.

The RespectUs Business Analyst team started working on this new regime on 15 January 2024 (the date of publication in the Official Journal), and it has now been published in the RespectUs Knowledge Base on 16 January 2024, the date of the entry into force.

EU legislation

As the RespectUs platform integrates real-time updates to the EU sanctions regimes, businesses can immediately adjust their operations in response to any changes.

For any upcoming amendments of the Decision or Regulation or additions of physical persons or entities to the list of persons exposed to travel bans and financial sanctions, the internal RespectUs process stays the same.

Our commitment is to provide any real-time updates for the date of entry into force of the corresponding legal provisions.

Adapting to Global Regulatory Changes

RespectUs’s agile response underscores the necessity for businesses to remain adaptable in the face of shifting international regulatory landscapes. Their proactive approach assures clients that their trade activities align with the most current legal requirements, thereby mitigating any potential risks associated with non-compliance.
